US Online Privacy Policy
Hunkemöller B.V. and its subsidiaries (further also referred to as Hunkemöller, or we, us, our) are committed to protecting your personal data. When you visit our stores, use our webshop or app, purchase our products, when you become a Hunkemöller Member, or when we provide customer support services, it is important to us to use your personal data carefully and securely in a transparent manner. In this Privacy Statement, we explain when we collect your personal data, what personal data we collect, how we use such personal data, and how long we keep your personal data in relation to our stores, webshop and app. If you have any questions, please contact us.
If we materially change this policy, we will notify you of the change(s) by posting a notice on our website and posting an updated version of the policy on our website as well.

If you have any questions about our Privacy Statement or want to exercise your rights as explained in our Privacy Statement, please let us know.
The shipment of all goods and payment processing is handled for us by a third party, currently Global-E Online Ltd., as primary responsible for the cross boarder delivery of the product from the moment it leaves the Hunkemoller warehouses to your delivery address.

2. When do we collect personal data and when does this privacy statement apply?
2.1 If you become a member of Hunkemöller and create a My Hunkemöller account
If you would like to benefit from an even better and more personal shopping experience, you may choose to become a member of Hunkemöller. You can become a member by registering directly online on our website by creating a My Hunkemöller account. You can only create an account if you also wish to become a member.
Tailoring marketing communications to your interests: As a member, you will receive by email, regular mail or online personalised advertisements (through e.g. Google Customer Match), offers, information on our promotions and events, product suggestions and recommendations you may be interested in that are even more relevant to your online shopping with us. We tailor our online advertisements, offers, services, communications, suggestions and recommendations to you based on the personal data that we obtain directly or indirectly from you, on the basis of your shopping behaviour, as described under "what personal data we collect", which includes your shopping, purchasing and browsing behaviour, your location and demographic group, your preferences and size information, and time of your last online purchases.
Seamless experience in an online shopping: As a member, we want to provide you with a seamless experience in our webshop.
- Becoming a member by creating a My Hunkemöller account: You can create a My Hunkemöller account in our webshop by using your email address or by logging in via your Facebook account. You can only create a My Hunkemöller account if you also wish to become a member. Thus, your My Hunkemöller account and personal data collected via your registration, activation and use of your My Hunkemöller account will be linked automatically with your membership. Please see under the section “if you use our webshop (without an account)” for more information on how we handle your personal data in general when you use our webshop or app.
- Keeping your purchase history: When you place your order via the webshop through your My Hunkemöller account, the details of your orders will automatically be linked to your My Hunkemöller account, and you will have an overview of what you have previously purchased from us available in your My Hunkemöller account. Online - your My Hunkemöller account on our webshop - you will see an overview of your last 10 online orders.
- Personalisation and targeting with cookies: If you are logged-in on your My Hunkemöller account as a member and provided your consent to the use of cookies via the cookie banner on our webshop or app, we will collect the products or content you viewed, products you added to your shopping basket but did not yet purchase, to track your shopping habits, advertisements you viewed or interacted with, and your potential interests gleaned from such browsing behaviour. Based on the information we collect when you are logged-in, we will make your shopping with us more efficient and tailored to you by showing you products in our webshop you might also love based on products bought by other similar customers, showing you more relevant advertisements on our webshop, and on websites of third parties showing our advertisements, send you an email on whether you wish to complete your order for the items you left in your shopping basket, and tailoring marketing communications to you. You can of course always choose not to be logged-in in your My Hunkemöller account when ordering products on our webshop. Please see under the section “if you use our webshop (without an account)” for more information on how we handle your personal data then.
Managing your membership and personal data: In addition to contacting us using the contact details below, you can also directly manage your privacy settings (providing your consent or withdrawing your consent to receiving marketing communications), or, adjust or correct your address, email address, preferences, and size information via your My Hunkemöller account. If you want to cancel your membership, please contact us.
Children and becoming a member and shopping online: Our website is designed and intended for those who have reached the age of majority (18 years of age). By using our website, you affirm that you are at least 18 years of age or older. We are not liable for any damages that may result from a user’s misrepresentation of age.
No one under age 13 is authorized to become a member or submit or post any information, including personal information, on our website. Under no circumstances may anyone under age 13 use our website. Parents or legal guardians of children under 13 cannot agree to these terms on their behalf. We do not knowingly collect personal data from children under the age of 13. If you are a parent or legal guardian and have reason to believe that your child under the age of 13 has provided personal data to us, please email us using the contact details below, or email our data protection officer at Privacy-US@hunkemoller.com, and we will endeavour to delete that information from our databases.

2.1.2 Why do we collect this personal data?
To provide you all benefits of your membercard and allow you to benefit from a more personal shopping experience tailored to your interest, preferences, wishes, and things you may love, we collect and use the following personal data of you, depending on whether you have activated your membercard (if you have not yet activated your My Hunkemöller account, we will only process the member registration details you provided in-store and your in-store purchases to provide and administer Passion Points), completed your My Hunkemöller account registration details, and your interactions with us:
- If you provided consent to receiving marketing communications such as newsletters and push notifications via the app, we will use you contact details to send you marketing communications.
- To provide you personalized and more relevant offers, discounts, invitations, online store suggestions and recommendations tailored to you based on your personal data collected online in our webshop, including your purchases, where you have purchased products, such as which shop, size information, Sexy Shapes, Favorite Fits, date of birth, viewed products and advertisements, products added to your online shopping basket, or advertisements you interacted with.
- If you provided consent, to show you relevant advertising on social media, such as Facebook and Instagram or on websites of third parties, such as search engines or third-party advertising that may appear on other websites of third parties you visit.
- Contact you with important information relating to your membership or purchases, including confirming your order.

2.1.3 How did we obtain your personal data?
We may obtain your personal data directly from you, such as when you register or create a My Hunkemöller account, visit our webshop, place orders, ask questions or give feedback. We may also receive your personal data from third parties, such as the cookie providers listed in our Cookie Policy , Facebook if you have used your Facebook account to login to our website and logistic services we use to handle online orders and returns
If you choose to link to your social media account through our webshop or app, including, but not limited to, Facebook, Instagram, Twitter or Google, we may collect information from your social media accounts. Additionally, these third-party social media web sites may also collect information from you in order to provide the services through our webpage or app. To learn more about the types of information those third-party web-sites collect, review those web sites’ privacy policies and terms of use. By submitting a telephone number or email to us you agree that our representative can contact you (i) at the number you provide, potentially using automated technology (including texts/SMS messaging) or a pre-recorded message and (ii) at the email you provide to us. Your consent is not an obligation to receive any of our products.
2.1.5 How long do we retain your personal data?
We retain different types of personal data for different periods, depending on the purposes for processing the information, our legitimate business purposes as well as pursuant to legal requirements. Please note that your data will not be stored longer than necessary.
2.2 If you use our webshop and place orders without an account
You can visit our webshop, and shop in our webshop also without an account. We will then process your personal data in relation to your visit to our webshop or app. If you place orders, we will also process your personal data to ensuring that your order is handled properly.
- Targeting you using cookies: If you provided your consent to the use of cookies via the cookie banner on our webshop, the advertising cookies from third parties we use allow these third parties and us to recognize your device and track your browsing behaviour on our webshop and on third-party websites. These cookies collect information on the products or content you viewed, products you added to your shopping basket did not yet purchase, track your shopping habits, advertisements you viewed or interacted with, and your potential interests collected from such browsing and shopping behaviour. We tailor our online advertisements, offers, services, communications, suggestions and recommendations to you based on the personal data that we obtain directly or indirectly from you, on the basis of your shopping behaviour.

- If you allow browser push notifications on our website, we will send you marketing communication via your web browser. We will collect your Membercard number, first and last name and your Device ID.
- Any questions, requests, feedback, or complaints.
- If you write a product review on our website: email address, IP address, device information.
- In addition, we also use the following personal data of you if you place an order:

- Delivery and billing address: Your delivery address will be shared with our external delivery/transport partners who will take care of the delivery of your purchases to your delivery address.

- Details of your order: time of your purchases, purchased products, details of the purchased products, including their size, color, and price.
- Payment details: bank account number, bank or credit card number, time of payment, payment method, including if you selected to pay your order after delivery. We do not store any payment account or card numbers once the transaction has been completed. We share your personal information with credit card companies and other payment providers for the payment of your transaction.

We obtain your personal data directly from you when you provide your information when placing an order or visit our web shop, allow push notifications in your browser, write a product review, ask questions or make requests. We may also receive your personal data from third parties, namely cookie providers listed in our Cookie Policy and logistic services we use to handle online orders and returns.
2.2.4 How long do we retain your personal data?

2.3 If you participate in events or competitions run by Hunkemöller
We love to do something extra for our customers and give you the opportunity to enjoy shopping events, enter competitions to get access to exclusive events, and win great prizes. If you participate in any event, prize draw or competition we organize for our customers, we find it important to protect your privacy and only collect the information necessary to participate in the event, prize draw or competition and provide your prize if you win a prize draw of competition. We have various win contests and prize draws on our social media channels and blog, and if you review or test our products. Specific additional terms and conditions apply to each prize draw or competition. Please read such additional terms and conditions for more information on the rules for how you can participate and win. You must be at least 18 years or older to be able to participate in event and private draws and competitions.

- To analyze and evaluate on a general aggregated basis the participation in events, prize draws and competitions and improve them, so our customers enjoy such evens, prize draws and competitions even more. We do not use your personal data obtained in relation to events, prize draws or competitions for any other purposes, including not to enrich other personal data collected from you.

We obtain your personal data directly from you when you enter event, the prize draw or win contest.

2.4 If you are or work for a supplier or business partner
We work together with several suppliers and business partners. As a supplier or business partner with you own business as a sole trader, or as a person working for one of our suppliers or business partners, we process limited personal data when you, as a representative or contact person of our supplier or business partner, enter into an agreement with us, trade or provide services to us, or visit our premises.

The processing of your personal data in case you contact our customer service, through the ‘Contact Us’ form, are subject to Privacy Rules of the Global-e, available here.
3. How is technology used to serve our advertisements on other online services and what choices do you have?
We contract with third-party advertising companies, which may collect information about your use and interactions with the Services, over time and across third-party websites and online services, for use in delivering tailored online display and banner advertising to you on other websites and online services. To serve this advertising, these third-party companies place, use, or rely on the technologies described above, including cookies, to obtain information about customer interactions with us and interactions with other online services. These companies use the information they collect to serve you ads that are targeted to your interests.
You can specify your preferences over the use of some of these technologies by visiting our Do Not Sell My Personal Information page and selecting the Cookie Preferences tab to view or change your preferences (to address future cookie placement).
You may also specify your preferences through a centralized registry. To learn about how to opt out of interest-based advertising, in general, click the following: NAI Opt Out or, DAA Opt Out. Your mobile device settings may allow you to prohibit mobile app platforms (such as Apple and Google) from sharing certain information obtained by automated means with app developers like us and other businesses.
Our Services do not respond to "Do Not Track" signals.
4. Who will have access to your personal data?
When you place an order on webshop or app, your credit/debit card information is securely transferred to Global-e, one of the largest and most trusted payment gateway providers. Your contact information is sent to their warehouse so that they can fulfill your order
We use other third-party service providers to perform Customer Relationship Management (CRM), email marketing campaigns, online advertising (through platforms such as Google or Facebook), customer analytics (such as Selligent), customer satisfaction surveys (The Choice), uploading and sharing of your social media posts or other content (Flowbox), fulfilment of orders, delivery, returns, refunds, payment providers handling your payment, and IT services. In providing the services, your personal data will, where applicable, be processed by the third-party service provider on our behalf. When we use the services of such third-party service provider that processes your personal data on our behalf, acting as a data processor, we have written data processor agreements in line with applicable data protection laws in place to safeguard the proper and secure processing of your personal data and ensure compliance with international data transfer restrictions.
Depending on your choices, your personal data may also be shared with social media providers such as Facebook and Instagram. Hunkemöller has no control over the privacy practices of these social media providers. Please read their privacy statements carefully for information on how they handle your personal data. When you share social media content that gets featured by us with your consent, your content will be available publicly and third parties could share or use your content without our knowledge and approval. Hunkemöller is not able, nor responsible, for the processing of or removing content that has been obtained or shared by such third parties. You can contact these third parties directly to request them to remove your content.
We may also disclose your information to third parties where we sell any or all of our business and/or our assets to a third party, whether through bankruptcy proceedings or other sale or merger, where we are legally required to disclose your information, including, but not limited to, pursuant to a valid subpoena, order, search warrant or other law enforcement request, or where we are contractually obligated to disclose it.
Where we disclose personal information for a purpose set forth herein, we enter a contract with the third-party that describes the purpose and requires the third-party recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.
5. How do we protect your personal data?
We are committed to ensuring that your personal data is kept secure. To prevent loss or unauthorized access, disclosure or alteration, we have put in place appropriate physical, technical and organizational measures to safeguard the personal data we collect and process. All of our employees and third party service providers acting as our data processor (i.e. those who process your personal data on our behalf) who have access to, and are associated with the processing of personal data, are obliged to respect the confidentiality of your personal data.
6. What choices do you have over how your information is used?
6.1 Emails, phone and text messages. We want to communicate with you only if you want to hear from us. If you prefer not to receive promotional information, such as information about special offers and sales events, you can let us know by contacting us. Additionally, you can opt out of email messages at any time by clicking the “opt-out/Unsubscribe” link at the bottom of any marketing message you have received from us.
Please be sure to include your full name and the email address you used when you registered with or made a purchase with our webshop or by phone. If you ask us to remove your name and address from promotional lists, we will maintain your name in a "do not contact" file. It may take up to 10 business days to process your email request, during which period you may continue to receive communications from us.
Please note that when you make additional purchases at our webshop or by phone, we will continue to confirm your order status and shipment by email. We may also need to contact you via telephone, email or postal mail with questions or information regarding your order.

1. To know what categories of personal information about you we have collected and used, including how the personal information was collected;
2. To know what categories of personal information is being sold or disclosed and if it is being sold or disclosed to third parties and a list of categories of information that are sold; or, if applicable: to know that your personal information has not been sold.
3. To opt out of the sale of your personal information;
4. To access your personal information, including the right to download or transfer personal information collected during the previous 12 months (see below “Access to Specific Information and Data Portability Rights”);
5. To request that your personal information be deleted (see below “Deletion Request Rights”); and
6. To equal service and equal price for goods or services even if you exercise your rights under the CCPA.

For all requests, it is helpful to put the statement “California Privacy Rights” in the body of your request, describe the nature of your request, and provide your name, street address, city, state, and zip code. To help protect your privacy and maintain security, we take steps to verify your identity before granting access to information or complying with a request. These steps include first verifying the email address you submit with your request. You will receive an email from us with instructions on completing this step. You will then be contacted to provide additional verification information, which may include your phone number, billing or shipping address, order history, a copy of a utility bill, emails showing order/shipping confirmation, and/or a signed declaration.
To submit a request as an authorized agent on behalf of a consumer, contact us via email. In this email, please add information about the individual for whom you are submitting the request. Please add your name and phone number and an indication that you are submitting the request as an authorized agent.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. In your request, you need to provide enough information that allows us to reasonably verify that you are the person that we collected information about.
Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us at the address or phone number above in this Section.
Access to Specific Information and Data Portability Rights
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request regarding exercising access, data portability, and deletion Rights in the manner provided in this Section), we will disclose to you:
1. The categories of personal information we collected about you.
2. The categories of sources for the personal information we collected about you.
3. Our business or commercial purpose for collecting or selling that personal information.
4. The categories of third parties with whom we share that personal information.
5. The specific pieces of personal information we collected about you (also called a data portability request).
6. If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
• Sales, identifying the personal information categories that each category of recipient purchased; and,
• Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request as detailed in this Section, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
3. Debug products to identify and repair errors that impair existing intended functionality.
4. Exercise free speech protect the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
8. Comply with a legal obligation.
9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Non-Discrimination for Exercise of Privacy Rights
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Financial Incentive Notice
We sometimes offer exclusive price discounts, rewards, offers, deals, coupons, services and other perks for (1) recipients of our mailing lists who were presented with a financial incentive to sign up; (2) applicants or registrants who were presented with a financial incentive for their application or registration; (3) any other situation?. Through these program offerings, consumers may provide us with some personal information (e.g., name, postal address, email address and other similar forms of personal information) when they opt-in to our programs. There is no obligation to opt in and consumers may opt out. The details of each program are contained in the program offering. We offer these programs to, among other things, enhance our relationship with customers. The value to our business, in the aggregate, of customers’ personal information depends on specific facts, such as whether and to what extent they take advantage of any offerings. We do not calculate the value of the customers’ information for our accounting statements. To the extent we would, however, these financial incentives are reasonably related to the value of the data you provide.
